This website is operated by Emán Estudio, a sole proprietorship of Cosette Rosales in Maryland, United States.
By using www.eman-estudio.com you agree to these terms. If you do not agree to them, please do not use the site.
These terms govern your use of the website. They are not the agreement under which the studio carries out work — that is a separate written agreement described in Section 3.
The site exists to show the studio’s work and to let people who want to work with it get in touch. Everything on it is provided for general information.
The studio takes care to keep the site accurate, but does not promise that it is complete, current, or free of errors. Project descriptions, timelines, and figures describe past work or general practice, and are not promises about future work.
Nothing on this site is an offer capable of acceptance. Submitting the inquiry form does not create a client relationship, reserve a place in the studio’s schedule, or commit either side to anything.
Where the site gives a price, it is a starting point, not a quotation. What a project actually costs depends on its scope, complexity, and timeline. A price is only fixed once it is set out in a written proposal.
Work begins only when a written proposal has been accepted by both sides and the first payment has been received. That signed proposal, together with any document it refers to, is the whole agreement between the studio and the client, and it takes precedence over anything on this website. If the two ever conflict, the signed proposal governs.
Everything on this site — the design, layout, code, typography, interactions, photographs, images, illustrations, video, and written content — belongs to Emán Estudio or to the people who licensed it to the studio, and is protected by copyright and other rights.
Client work appears here with permission. The brand names, logos, product names, and trade marks of the studio’s clients belong to those clients, and nothing here gives you any right to use them.
The name Emán Estudio, the studio’s wordmark, and its visual identity belong to the studio.
You may view the site, and share a link to it. You may quote a short passage or reproduce a single image to write about, review, or reference the studio’s work, as long as you credit Emán Estudio and link back to the page you took it from.
You may not, without written permission from the studio:
Inspiration is not infringement, and the studio takes no issue with anyone learning from the work. Reproducing it is different.
When you use the inquiry form or send an email, you confirm that what you send is accurate to the best of your knowledge and that you are entitled to share it. Please do not send confidential material before there is an agreement in place — send enough to start a conversation, not your unreleased product roadmap.
The studio does not accept unsolicited creative ideas, concepts, or proposals. If you send one anyway, the studio is free to work on similar things without owing you anything. This is not a claim on your idea; it is a protection against a coincidence being mistaken for a taking.
Section 7 and the privacy policy explain what happens to the information you send.
The privacy policy explains what personal information the studio collects, why, who it is shared with, and what rights you have. It forms part of these terms.
The site links to other websites, including client work, social platforms, and press coverage. Those sites are not controlled by the studio, and linking to one is not an endorsement of it. The studio is not responsible for their content or their practices.
The site is made available on an “as is” and “as available” basis. To the fullest extent the law allows, the studio makes no warranties of any kind about it — including that it will be uninterrupted, secure, error-free, or free of anything harmful.
The studio may change, suspend, or withdraw any part of the site at any time, without notice.
To the fullest extent the law allows, Emán Estudio is not liable for any indirect, incidental, consequential, or special loss arising from your use of this site — including lost profit, lost business, lost data, or lost opportunity — even if the possibility was known.
Where liability cannot be excluded, the studio’s total liability for anything arising out of your use of the site is limited to one hundred US dollars ($100).
Nothing in these terms limits liability for fraud, for fraudulent misrepresentation, or for anything else that cannot lawfully be limited. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
This section is about the website. Liability for work the studio carries out for a client is dealt with in that client’s signed agreement, not here.
These terms may be updated from time to time. The “Last updated” date above will change when they are. Continuing to use the site after a change means you accept the revised terms.
These terms are governed by the laws of the State of Maryland, United States, without regard to its conflict-of-laws rules. Any dispute arising out of them will be brought in the state or federal courts located in Maryland, and you agree to those courts hearing it.
If you are a consumer resident in the United Kingdom, the European Union, or another jurisdiction whose law gives you the right to bring proceedings locally or to rely on mandatory protections that cannot be set aside by agreement, nothing in this section removes that right.
If any part of these terms is found unenforceable, the rest continues to apply. If the studio does not enforce something straight away, it has not given up the right to enforce it later. These terms, together with the privacy policy, are the whole agreement between you and the studio regarding your use of this site.
